The state's high courts regularly consider novel DUI defenses. In 2005 alone, for example, Virginia's state and federal courts issued over 14 written opinions explaining and interpreting Virginia DUI laws. This law changes every year but, just recently, in July, 2004 and 2005, the General Assembly dramatically overhauled the law. The law constantly changes because Virginia DUI cases are some of the most complex criminal cases to prosecute and defend. They involve constitutional issues, statutory construction issues, scientific issues, and factual issues. This site is designed to give you an overview of DUI law. Do not rely on it for legal advice. There is only one, 100% way to avoid a DUI conviction -- don’t drink and drive. This means, do not even have one beer before getting behind the wheel of an automobile.
